Civil Procedure Reform: Focus on Family and Minors
A significant part of Delegated Law No. 206/2021 entered into force on 22 June 2022. Several reforms concern family and minors law, a key area of civil litigation. Maura Magni, President and Managing Partner of BMV, discusses these developments in her article for 4cLegal.
“Together with the reform of civil procedure, the law comprehensively reforms the jurisdiction over family relationships, personal rights and minors, as well as the procedural rules governing family proceedings. It establishes the Court for Persons, Minors and Families and unifies the many existing procedures into a single process, as family lawyers had long requested in order to overcome inconsistencies and discrimination caused by procedural differences and, consequently, differences in rights,” Magni writes.
Among the reforms with immediate application is the new wording of Article 403 of the Italian Civil Code on the removal of minors, which introduces detailed judicial oversight of the procedure, appropriate and strict timelines, and the hearing of both the parties and the minor. Further reforms will be applied over the next two years, until the entire reform is fully in force by 2025.
